Terms of Service
These Terms of Service govern your access to and use of the Orbyt platform, website, publishing tools, branded pages, integrations, dashboards, analytics, and related services. By creating an account, using the service, or purchasing a plan, you agree to these Terms.

Orbyt depends on third-party platforms and providers, including hosting providers, payment providers, app stores, APIs, and social-media platforms such as Meta, TikTok, LinkedIn, YouTube, and others. We do not control those services and are not responsible for downtime, rule changes, account suspensions, API restrictions, reduced reach, removed content, demonetisation, or discontinued integrations. We do not guarantee that any post, campaign, message, or content will be published, accepted, displayed, ranked, delivered, or perform in a certain way on any third-party platform.
When you connect a Google account to use YouTube features, your use of those features is also subject to the YouTube Terms of Service and the Google Privacy Policy.

You are solely responsible for your content, your publication settings, your legal disclosures, and your compliance with applicable law and platform rules. You must ensure that you have all rights, licences, consents, and permissions needed for any content you upload, schedule, publish, or otherwise use through Orbyt.
You are also solely responsible for making sure that your use of the service complies with advertising law, consumer law, copyright law, trademark law, privacy law, platform rules, sanctions rules, and any other rules that apply to your content, business, or target markets.

You may not use Orbyt to post, store, transmit, or facilitate unlawful, infringing, misleading, defamatory, hateful, fraudulent, harassing, privacy-invasive, or otherwise objectionable content. You may not use the service for spam, impersonation, hidden advertising, malware, fake engagement, unlawful scraping, or attempts to interfere with the service or third-party platforms.
We may review, restrict, remove, suspend, disable access to, or report content, accounts, workspaces, or integrations where we reasonably believe there is a breach of these Terms, our policies, third-party platform rules, or applicable law, or where there is technical, legal, security, or reputational risk. We may do this with or without prior notice where reasonably necessary.
7. Subscription, billing, and price changes
Paid plans renew automatically unless cancelled before the next billing date. Fees are billed in advance and are non-refundable except where required by law or expressly stated in our Refund & Cancellation Policy.
We may change pricing, packaging, usage limits, included features, storage limits, or billing structure from time to time. If a change materially affects an existing paid subscription, we will give reasonable notice in advance, normally by email or in-product message, and the change will apply from the next renewal period unless mandatory law requires otherwise.
If payments fail, are reversed, or are flagged as fraudulent, we may suspend or limit paid features until the issue is resolved.
8. Intellectual property
You retain ownership of your content. You grant Orbyt a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, format, process, transmit, display, moderate, and otherwise use your content only as needed to provide, secure, improve, and support the service.
Orbyt and its licensors own the service, the software, the interface, the documentation, our branding, and all related intellectual property rights. Except for the limited rights expressly granted to you, no rights are transferred to you.

To the maximum extent permitted by law, Orbyt is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, data, reputation, or goodwill. Orbyt is not liable for claims arising from your content, your instructions, your connected accounts, third-party services, platform-side publication failures, or legal or commercial consequences of your own content or campaigns.
Where liability cannot legally be excluded, Orbyt’s total aggregate liability relating to the service will, to the maximum extent permitted by law, be limited to the amount you paid to Orbyt for the service during the 12 months before the event giving rise to the claim, or, where you have not made any payment, NOK 1 000.

Acceptable Use & Content Policy
You may use Orbyt only in a lawful, honest, and responsible way. The following uses are prohibited:
- Unlawful, infringing, defamatory, fraudulent, threatening, hateful, discriminatory, sexually exploitative, or privacy-invasive content.
- Hidden advertising, fake testimonials, fake engagement, spam, phishing, scams, or impersonation.
- Malware, malicious links, credential theft, harmful code, or attempts to compromise any account or system.
- Unauthorised scraping, reverse engineering, bypassing rate limits, or interfering with the security or stability of the service.
- Use of content without all necessary rights, consents, or licences.
- Posting or scheduling content in violation of the rules of any connected platform.
You are solely responsible for reviewing your content before publication, including timing, audience, disclosures, tags, and legal notices. We may take enforcement action, including warnings, content removal, feature restrictions, suspension, or termination, if this policy is breached or if there is legal, technical, or reputational risk.
Copyright & Takedown Policy
If you believe content on Orbyt infringes copyright or other rights, please send a notice to post@orbyt.no with:
- your full name and contact details;
- identification of the protected work or right allegedly infringed;
- identification of the content to be removed or disabled, including URL or other location details;
- a statement explaining why you believe the use is unauthorised;
- a statement that the information is accurate and that you are authorised to act on behalf of the rightsholder, where applicable.
We may request additional information, temporarily disable access to content, remove content, suspend accounts, or reject incomplete or abusive notices. We may also notify the affected user and allow a counter-notice where appropriate.
Refund & Cancellation Policy
Paid plans renew automatically unless cancelled before the next billing date. You can cancel renewal from your account settings or by contacting support, subject to any app store rules if you subscribed through an app store.
Unless required by mandatory law, subscription fees already paid are non-refundable, and downgrades or cancellations take effect at the end of the current billing period. We do not generally provide refunds for unused time, change of mind, lack of usage, or user-side setup issues.
If the law in your country gives you a mandatory right of withdrawal or refund, those rights apply to the extent required. If you subscribed through Apple, Google, or another third-party billing provider, refund handling may be subject to that provider’s rules and procedures.
Business Terms
These Business Terms apply to companies, agencies, organisations, and professional users purchasing Orbyt for business use. If there is a conflict between these Business Terms and the consumer-facing Terms of Service, these Business Terms govern for the business customer relationship.
